Trademark Registration Category Disciplines
Operating without a registered trademark leaves your enterprise vulnerable to counterfeiting, passing-off litigation, and domain hijacking. Explore our four specialized trademark registration disciplines.
Word Mark & Corporate Trade Name
Word marks offer the highest level of commercial security by establishing exclusive legal rights over plain textual words, taglines, and abbreviations across all print, digital, and broadcasting applications.
- Absolute phonetic and textual exclusivity nationwide
- Complete flexibility to modify typography, styling, and color palettes
- Comprehensive prevention of deceptively similar domain and business names
Device, Logo & Composite Marks
Device and composite marks safeguard stylized brand iconography, artistic emblems, geometric badges, and combinations of artistic graphics with text, ensuring brand recall remains legally untouchable.
- Protection of exact artistic representations and graphical emblems
- Defense against visual imitation and deceptive packaging look-alikes
- Essential protection for physical retail storefronts and e-commerce apps
Multi-Class Portfolio & Nice Mapping
Modern conglomerates, D2C brands, and SaaS enterprises operate across diverse verticals. We structure multi-class filings across the 45 Nice international classes to provide seamless commercial coverage without gaps.
- Classes 1 to 34 for physical merchandise, manufacturing, and consumer goods
- Classes 35 to 45 for SaaS, consulting, technology, finance, and hospitality
- Multi-class Form TM-A filings engineered for cross-industry scalability
Objection Defense & Hearing Advocacy
Over 60% of trademark applications receive statutory objections under Section 9 (distinctiveness) or Section 11 (conflict with existing marks). Our registered IP attorneys draft legal replies and appear in registry hearings.
- Section 9 distinctiveness and acquired secondary meaning defenses
- Section 11 conflicting mark differentiation and co-existence arguments
- Formal opposition defense (Form TM-O) and virtual hearing representation
Our Trademark Lifecycle: Audit To Certificate Grant
Securing a registered trademark requires rigorous legal screening, accurate classification drafting, and persistent prosecution through departmental examination. Here is how our IP attorneys manage your registration workflow.
Comprehensive IP Search & Class Mapping
We execute exhaustive searches on the Indian Trademark Registry database across phonetic, visual, and conceptual parameters to evaluate registrability and eliminate conflict risks.
Form TM-A Filing & TM Symbol Grant
Our registered attorneys draft goods/services specifications, execute user affidavits (Form TM-48 power of attorney), and electronically submit Form TM-A to generate your official application number.
Examination Review & Objection Reply

Nice Classes, Timelines & Brand Protection Answers
Clear answers regarding TM vs ® symbols, government filing fees, examination objections, multi-class mapping, and international trademark protections.
The ™ (Trademark) symbol indicates that an application for registration has been filed with the Trade Marks Registry and is currently under examination. You can legally use the ™ symbol immediately upon receiving the official Form TM-A filing acknowledgment. The ® (Registered) symbol can only be used once the registration process is fully completed and the official Certificate of Registration is issued by the Registrar.
To file Form TM-A, you need: the applicant's PAN and Aadhaar identity proof, business incorporation certificate or partnership deed (for corporate applicants), MSME/Udyam certificate or Startup India DPIIT recognition (to claim the 50% government fee concession), high-resolution brand logo file (if filing a device/logo mark), user affidavit proving prior commercial usage date (if claiming usage prior to application), and a signed Form TM-48 (Power of Attorney).
The statutory government filing fee for individuals, sole proprietors, registered MSMEs (Udyam), and DPIIT-recognized startups is ₹4,500 per class for electronic filing. For non-MSME companies, LLPs, trusts, and large corporations, the government filing fee is ₹9,000 per class for electronic filing. Physical paper filings attract a 10% premium.
The Nice Classification is an international taxonomy system dividing goods and services into 45 distinct classes. Classes 1 through 34 cover physical goods and manufactured products (e.g., Class 25 for clothing, Class 9 for software/electronics, Class 5 for pharmaceuticals), while Classes 35 through 45 cover services (e.g., Class 35 for retail/business management, Class 42 for IT/software services). Our attorneys assess your business model to select the classes offering optimal commercial protection.
The complete trademark registration cycle typically takes between 6 to 12 months. You receive your application number and the legal right to use the ™ symbol within 24 hours of filing. If the registry issues an examination objection (under Section 9 or 11) or if a third party files an opposition during the 4-month Journal advertisement period, the timeline extends depending on hearing proceedings.
Section 9 objections arise when a mark is deemed devoid of distinctive character, overly descriptive of the goods/services (e.g., trying to trademark 'Cold' for ice cream), or generic. Section 11 objections arise when the examiner identifies identical or deceptively similar existing trademarks on the register for identical or related goods/services. Our IP attorneys draft specialized legal counter-arguments and submit prior use evidence to overcome these objections.
An Examination Report is an official departmental assessment issued by the Trade Marks Registry after reviewing your application. If the examiner raises objections, an Examination Report is published online. The applicant has a strict statutory window of 30 days from the date of receipt to submit a comprehensive legal response. Failure to file the reply within 30 days causes the application to be marked 'Abandoned' by the registry.
A trademark registration in India is valid for 10 years from the date of the original application. It can be renewed indefinitely every 10 years by filing Form TM-R along with the prescribed government renewal fees. Renewal applications can be filed within 6 months prior to the expiration date.
No. Trademark rights are strictly territorial. A registration granted under the Trade Marks Act, 1999 protects your brand exclusively within India. However, once you have filed or registered a basic application in India, you can expand protection internationally across more than 130 member countries through the Madrid Protocol administered by the World Intellectual Property Organization (WIPO).
Submit your brand name or logo through our consultation desk. Our registered IP attorneys will conduct an immediate trademark clearance search, map your product/service classes, prepare your Form TM-A e-filing dossier, and generate your application number within 24 hours.
